Sessions of the National Council may be organised under the conditions set out in Article R. 133-7 of the code des relations entre le public et l’adminis.
Board members may not take part in deliberations when they have a personal interest in the matter under discussion.
The Board may only validly deliberate when, in addition to the Chairman or one of the Vice-Chairmen, two of the members mentioned in 1° to 6° of article L. 1212-1 and two of the members mentioned in 7° of the same article. The secretariat of the national council is provided by the ministry responsible for local authorities.
Minutes are taken of the Board’s deliberations. They are signed by the Chairman of the meeting and indicate the names and positions of the members present, the matters dealt with during the meeting and the meaning of each of the deliberations.
The functions of chairman and member of the National Standards Assessment Board are free of charge. The travel expenses of non-parliamentary elected members constitute operating expenses of article L. 1212-3.
The National Council for the Assessment of Standards draws up its own rules of procedure, which may specify the procedures for examining cases. The rules of procedure are approved by the Minister responsible for local authorities.
The draft texts mentioned in I and III of article L. 1212-2 are accompanied by a presentation report and an impact assessment showing the technical and financial implications, whatever they may be, of the proposed measures for local and regional authorities. Draft technical standards resulting from standardisation or certification activities that have a technical or financial impact for local and regional authorities and their public establishments, which are referred to the National Council in accordance with IV of Article L. 1212-2 shall be examined in accordance with the conditions laid down by the rules of procedure.
A request for an assessment of regulatory standards in force applicable to local authorities or public establishments of inter-municipal cooperation with their own tax status may be submitted to the national council by a mayor, president of a public establishment of inter-municipal cooperation with their own tax status, president of a departmental council or president of a regional council.
