The oath is evidence only in favour of or against the person who has referred it and his heirs and assigns. The oath referred by one of the joint and several creditors to the debtor discharges the debtor only in respect of that creditor’s share. The judge may of his own motion refer the oath to one of the parties. This oath may not be referred to the other party. Its probative value is left to the judge’s discretion.
The court may only refer the oath of its own motion, either on the application or on the objection to it, if it is not fully justified or completely devoid of evidence.
