Title I: Practice of the medical professions

When it is available, the certified information mentioned in article L. 4113-1-1 serves as supporting documents for the fulfilment of the obligations set out in article L. 4113-1.

Separate lists of each of these professions shall be drawn up for each département by the relevant government department or the body designated for this purpose, and made available to the public. The procedures for applying this article shall be laid down by decree.

It is forbidden to practise medicine, dentistry or midwifery under a pseudonym.

Doctors, dental surgeons and midwives may not give consultations in premises or outbuildings of commercial premises where the equipment they prescribe or use is sold.

It is forbidden for any person who does not fulfil the conditions required for the practice of the profession to receive, by virtue of an agreement, all or a proportion of the fees or profits arising from the professional activity of a member of one of the professions governed by this book. Practising doctors, dental surgeons and midwives, as well as persons applying for registration on the roll of doctors, dental surgeons or midwives, must inform the departmental council of the Association to which they belong of any contracts or agreements relating to the practice of their profession and, if they do not own the equipment and premises in which they practise or will practise their profession, any contracts or agreements guaranteeing…

Failure to communicate contracts or amendments or, where it is attributable to the practitioner, failure to draw up a written document constitutes a disciplinary offence liable to result in one of the penalties provided for in article L. 4124-6 or to justify refusal of registration on the roll of the Association. Failure to communicate or false communication exposes the person making the communication to the penalties provided for in article L. 4124-6. The Bar Council may refuse to register candidates who have entered into commitments incompatible with the rules of the profession or likely to deprive the practitioner of the necessary professional independence.

The doctors, dental surgeons and midwives mentioned in the first paragraph of article L. 4113-9 may submit to the Association Council the draft contracts mentioned in the first and second paragraphs of the said article. The Association Council must make its observations known within one month.
