Section 2: Assignment of the debtor's assets.

The official receiver shall rule on the sale after receiving the observations of the auditors and hearing or duly summoning the debtor and his spouse, where the latter is in one of the situations provided for in Article R. 641-30, as well as the liquidator.

Orders made pursuant to Article L. 642-19 shall, at the registrar’s initiative, be notified to the debtor and communicated by simple letter to the auditors. Appeals against these decisions may be lodged with the Court of Appeal.

In the event of the sale of a business, the transferee may apply to the official receiver to have the registrations cancelled. He shall attach to his application a statement of the registrations, proof of completion of the purging formalities or of the agreement of the registered creditors to dispense with them, and proof of payment of the pre-sale costs.
