Section 2: Special payment vouchers

To be authorised, the issuer must demonstrate its ability to fulfil the obligations set out in article D. 1271-15.

Failure to comply with any of the obligations set out in articles D. 1271-13 to D. 1271-15 may result in suspension or withdrawal of authorisation by the Minister responsible for personal services.

The organisations and institutions authorised to issue the special payment voucher referred to in B of article L. 1271-1, on paper or in dematerialised form, receive remuneration from the natural or legal persons who provide the pre-financing.

The authorised issuer must notify the Minister responsible for personal services without delay, by registered letter with acknowledgement of receipt: 1° Any takeover, acquisition or takeover of control by one or more third parties, the transfer or cessation of the business or activity for which the organisation or establishment is authorised, as well as the opening of safeguard, receivership or compulsory liquidation proceedings as provided for in Book VI of…

In order to assess the conditions for maintaining authorisation, the Minister responsible for personal services may, at any time, ask the authorised issuer to update the documents in its authorisation application file.

In the cases provided for in article D. 1271-19, the Minister responsible for personal services will consult the Banque de France and the Agence centrale des organismes de sécurité sociale. The activity of issuing the special payment voucher referred to in B of article L. 1271-1, for which issuers are authorised by the Minister responsible for personal services, is monitored and controlled by the Minister with the support of the Banque de France and the Agence centrale des organismes de sécurité sociale.

Before 30 April each year, the authorised issuer of the special payment voucher referred to in B of Article L. 1271-1 sends the Minister responsible for personal services and the Banque de France, by registered letter with acknowledgement of receipt: 1° An activity report covering the previous calendar year of issue. Before 30 June each year, the authorised issuer, other than a credit institution, sends the Minister responsible for personal services, by registered letter with acknowledgement of receipt, a report on the management during the previous calendar year of issue of the specific guarantee bank accounts provided for in article L. 1271-11.

If it is found that the authorised issuer does not comply with the provisions set out in 1° of Article D. 1271-13, authorisation may be suspended or withdrawn by decision of the Minister responsible for personal services, after obtaining the opinion of the Banque de France.
