The purpose of project management contracts is to carry out one or more elements of the task defined in article L. 2431-1, with a view to the completion of a work or an urban or landscape project. These contracts are awarded in accordance with the procedures laid down in this section and, where they and the purchasers who conclude them come under Book IV, in compliance with these provisions.
For purchasers subject to Book IV, project management contracts that meet a need for an amount equal to or greater than the formal procedure thresholds are negotiated, pursuant to article R. 2122-6, with the winner or winners of a restricted competition organised under the conditions of articles R. 2162-15 to R. 2162-21. For other purchasers, project management contracts that meet a need whose estimated value is equal to or greater than the thresholds for a formalised procedure are awarded in accordance with one of the procedures mentioned in Chapter IV of Title II or, if the conditions mentioned in Chapter II of Title II are met, without prior advertising or competitive tendering.
When the purchaser is subject to Book IV and organises a design contest, economic operators who have submitted services in accordance with the contest rules are awarded a premium. Where the purchaser is not subject to Book IV or where it does not organise a design contest, economic operators who have submitted services that comply with the consultation documents are awarded a premium, the amount of which is freely determined by the purchaser.
The amount of the premium referred to in this sub-section is indicated in the consultation documents and the remuneration of the holder of the project management contract takes account of the premium received for his participation in the procedure.
Public authorities subject to the obligation to decorate public buildings shall award contracts for the purpose of fulfilling this obligation in accordance with the provisions of this section.
A contract for the decoration of public buildings is awarded under the conditions set out in this paragraph when the following two conditions are met:1° It involves the commissioning of one or more artistic works to be created;2° Its value is less than the European thresholds mentioned in a notice annexed to this code.
The purchaser shall set up an artistic committee under the conditions set out in sub-section 3, as soon as the preliminary outline project defined in article R. 2431-10 has been approved.
The artistic committee draws up the programme for the artistic commission, specifying in particular the nature and location of the work envisaged, and then submits it to the purchaser for approval.
