Chapter IV: CONTENTIOUS PROCEEDINGS

If the decision imposing an obligation to leave French territory is annulled, the surveillance measures provided for in articles L. 721-6, L. 721-7, L. 731-1, L. 731-3, L. 741-1 and L. 743-13 are immediately terminated, and the foreign national is issued with a provisional residence permit until the administrative authority has ruled on his case again.

If the decision not to grant a period for voluntary departure is annulled, the surveillance measures provided for in articles L. 731-1, L. 731-3, L. 741-1 and L. 743-13 are immediately terminated, and the president of the administrative court or the magistrate appointed for this purpose reminds the foreign national of his obligation to leave French territory within the period set for him by the administrative authority pursuant to articles…

If the house arrest decision provided for in article L. 731-1 is annulled, this measure is immediately terminated and the president of the administrative court or the magistrate appointed for this purpose reminds the foreign national of his obligation to leave French territory.

The annulment of the decision relating to residence entails the repeal of the decision imposing an obligation to leave French territory and any accompanying decision imposing a return ban, including where the appeal against these has been rejected in accordance with the procedure laid down in Articles L. 614-7 to L. 614-13.
