Sub-section 2: Provisions specific to public corporations with legal personality and financial autonomy, entrusted with the operation of a public service of an industrial and commercial nature (R)

Materials accounting, the purpose of which is to describe existing stock and movements concerning inventories and movable property, is kept under the responsibility of the director of the régie.

The rates of the fees payable by users of the public service authority are set by the Board of Directors. The rates are set in such a way as to ensure the financial equilibrium of the public service authority under the conditions provided for in articles L. 2224-1, L. 2224-2 and L. 2224-4.

Allocations to depreciation and provisions are calculated in accordance with the provisions and customary periods applicable to commercial enterprises in the same sector of activity. Depreciation relates to movable assets other than collections and works of art, buildings with the exception of non-income-producing land and intangible fixed assets. Fixed assets may be revalued in accordance with the provisions applicable to commercial enterprises.

The régie may receive accepted bills of exchange in settlement of its receivables, endorse them or remit them for collection. Bills received in settlement may be discounted in accordance with commercial practice. Certain expenses fixed by the Articles of Association may be settled by means of bills.

La régie peut, dans les conditions prévues à Article L. 2253-1, acquire financial holdings in public, semi-public or private companies that carry out a complementary or related activity. The public service authority is authorised to contract loans from all lending organisations and private individuals. It may also acquire or arrange for the construction of movable and immovable property payable in instalments to assignors and contractors.
