Section 4: Provisions applicable to certain categories of employers and self-employed workers

The contribution provided for in article L. 6331-48 is payable by self-employed persons, with the exception of those whose remuneration cannot be taken into account to determine the amount of wages, within the meaning of article 231, paragraph 1 of the General Tax Code, mentioned in the first paragraph of article L. 6331-48 and in article L. 6331-53. The persons referred to in the first paragraph of article L. 6331-53 may only benefit from their training requests being paid for by the skills operator referred to in 1° of the same article if they are up to date with payment of the contribution provided for in this article. They must provide proof of this condition by producing a payment certificate supplied by the collecting body.

The persons mentioned in the first paragraph of article L. 6331-53 join the skills operator mentioned in 1° of the same article.

Approval of the skills operator referred to in 1° of Article L. 6331-53 is granted by joint order of the ministers responsible for vocational training, seafarers and sea fishing. The granting of approval is subject to the condition that the skills operator operates in a field characterised by occupations, jobs and skills close to those of self-employed sea fishermen and sea fishery employers with fewer than eleven employees, as well…

Approval may be withdrawn by joint order of the ministers responsible for vocational training, seafarers and sea fishing if the legal provisions applicable to the organisation or any special conditions set out in the approval are not complied with. The withdrawal decision is taken after the managing body has been called upon to explain itself.

The contribution provided for in Article L. 6331-53 is paid by the collection bodies to France Compétences, in accordance with the procedures specified in an agreement concluded respectively with the bodies mentioned in Articles L. 225-1-1 of the Social Security Code and L. 723-11 of the Rural and Maritime Fishing Code, after deduction of the management costs mentioned respectively in Article L. 6331-52 of this Code. The skills operator mentioned in 1° of article L. 6331-53 designates a special section within it. This section is managed by the trade union organisations representing self-employed workers and employers in maritime fishing and marine farming. Its funds are governed by the provisions of article R. 6332-77-1.
