The contract for mixed employment and professional equality between women and men may only be concluded after : 1° Either the conclusion of a collective labour agreement including exemplary actions in favour of professional equality between women and men; 2° The adoption of a professional equality plan; or 3° or the adoption of one or more measures to promote job diversity.
The contract for mixed employment and professional equality between women and men specifies: 1° The purpose and nature of the commitments made by the employer; 2° The amount of State aid and the terms and conditions of payment; 3° The terms and conditions for evaluating and monitoring the fulfilment of the commitments made.
The commitments made by the employer in the contract for mixed employment and professional equality between women and men must aim to make a significant contribution to establishing professional equality between women and men in the company or establishment, or to contribute to developing mixed employment, by adopting measures to raise awareness, recruit, train, promote and improve working conditions.
The contract for mixed employment and professional equality between women and men is concluded on behalf of the State by the regional prefect. If its scope goes beyond the regional framework, the contract is concluded by the minister responsible for women’s rights.
The State’s financial contribution to expenditure directly attributable to the implementation of the contract for mixed employment and professional equality between women and men, after deduction of value added tax, is calculated up to a maximum limit of a percentage that varies according to the nature and content of the actions: 1° 50% of the cost of investment in equipment related to the modification of the organisation and working conditions…
In order to qualify for financial assistance, actions in favour of employees on fixed-term contracts and temporary workers are taken into account when their contract, or the duration of their assignment, is six months or more.
The State aid provided for in article D. 1143-12 may not be combined with public aid for the same purpose.
If the company fails to comply with the contract for mixed employment and professional equality between men and women, the State aid will be repaid.
The Social and Economic Committee is regularly informed of the implementation of the commitments made by the employer in the contract for mixed employment and professional equality between women and men.
The report on the implementation of the commitments made by the employer in the contract for mixed employment and professional equality between women and men is sent to the regional director of companies, competition, consumption, work and employment and to the departmental representative for women’s rights and equality.
