When entrusted with a mission, the expert masseur-physiotherapist must recuse himself if he considers that the questions put to him are foreign to the art of massage therapy, to his knowledge, to his possibilities or that they would expose him to contravene the provisions of the present code of ethics.
Before undertaking any expert assessment, the expert masseur-physiotherapist informs the person concerned of his mission and the legal framework in which his opinion is sought.
In drafting his report, the expert masseur-physiotherapist must only reveal information that is likely to provide an answer to the questions asked. Outside these limits, he must not reveal anything that he may have learned in the course of this expert assessment. He certifies that he has carried out his mission personally.
All masseur-physiotherapists, when they are entered on the roll, certify to the Conseil Départemental de l’Ordre that they are aware of this code of ethics and undertake under oath to comply with it.
Any deliberately inaccurate or incomplete declaration made to the local council by a masseur-physiotherapist may give rise to disciplinary proceedings. The same applies to the concealment of professional contracts.
Any masseur-physiotherapist who changes his or her conditions of practice, including professional address, or ceases to practise in the department, is obliged to inform the departmental council of the Order without delay. The latter will take note of these changes and inform the national council.
Decisions taken by the Order of masseur-physiotherapists in application of these provisions must state the reasons on which they are based. The decisions of the departmental councils may be amended or annulled by the national council of the Order either ex officio or at the request of the parties concerned; in the latter case, the appeal must be lodged within two months of notification of the decision.
