Title IV: Exercise of trade union rights

Any director or manager of a trade union or union of trade unions who, in disregard of the provisions of the first paragraph of article L. 2131-2, opposes the free formation of a trade union or professional association of persons exercising the same profession, similar or related professions, contributing to the establishment of specific products or the same liberal profession, is punishable by a fifth-class fine.

Failure by a director or manager of a trade union or union of trade unions to file the articles of association in accordance with the conditions set out in article L. 2131-3 is punishable by a fine for a fifth-class offence.

Any director or administrator of a trade union or union of trade unions who, in disregard of the provisions of article L. 2131-4, opposes the access of a member of a professional trade union who fulfils the conditions laid down by article L. 2131-5 to the administrative or management functions of this trade union, shall be punished by the fine laid down for fifth class offences.

Any person who is deprived of his civic rights or who is subject to a ban, disqualification or incapacity relating to his civic rights, to perform the duties of manager or director of a trade union or union of trade unions, in disregard of the provisions of the first paragraph of article L. 2131-5, is punishable by the fine laid down for fifth-class offences.

Any director or manager of a trade union or union of trade unions who, contrary to the provisions of article L. 2141-1, opposes the free membership of an employee on the grounds of his or her sex, age, nationality, religion or beliefs, disability, sexual orientation or actual or assumed membership of an ethnic group or race, is liable to a fifth-class fine. Failure to comply with the provisions of articles L. 2145-11 and R. 2145-5, relating to refusal to grant economic, social and trade union training leave, is punishable by a third-class fine.
