Section 3: Health and safety coordination and coordinator.

The project owner appoints a health and safety coordinator from the start of the preliminary design phase, within the meaning of article 4 of decree no. 93-1268 of 29 November 1993 relating to project management assignments entrusted by public contracting authorities to private-sector service providers, or its equivalent, where the project is not subject to preliminary design.

When the project owner appoints a coordinator for the construction phase, separate from the coordinator for the design, study and project development phase, this appointment is made before the start of the consultation process with the contractors.

In order to ensure that the coordinator has the authority and resources needed to carry out his duties properly, the project owner shall, from the preliminary design stage, provide for cooperation between the various parties involved in the construction process and the coordinator. The practical details of this cooperation are set out in a document attached to the contracts signed with the various parties involved.

The project owner asks the building owner for the technical files containing information relating to the search for and identification of materials containing asbestos, as provided for in articles R. 1334-29-4 to R. 1334-29-6 of the Public Health Code andarticle R.126-10 of the Building and Housing Code or, where applicable, the asbestos detection report provided for in article R. 4412-97-5 of this Code. The project owner shall ensure that the coordinator is involved in the development and implementation of the project throughout all phases of the operation, in particular by giving him access to all meetings organised by the project manager and by sending him all studies carried out by the project manager within a timeframe compatible with the performance of his duties.

The project owner shall take account of the coordinator’s observations where he considers them justified, or shall adopt measures of at least equivalent effectiveness.

In the case of operations undertaken by a private individual which are not subject to obtaining a building permit, as provided for in 2° of Article L. 4532-7, coordination is ensured, during each of its interventions on the site, by the company whose share of the workforce in the operation is the highest.
