Performance studies may only be carried out in a place which has the human, material and technical resources appropriate to the performance study and compatible with the safety requirements of the persons undergoing it.
This place must be authorised for this purpose, for a specified period, in the case of performance studies involving an intervention on a person which is not justified by their usual care and which exposes them to risks and constraints which are not minimal, carried out outside places of care, as well as in hospital departments and in any other place where healthcare professionals practise when these studies require procedures other than those which they usually carry out as part of their activity, or when these studies are carried out on persons presenting a clinical condition other than that for which the department is responsible. This authorisation is granted by the Director General of the Regional Health Agency or by the Minister of Defence, if the site comes under his authority. However, authorisation is granted by the Minister for Veterans for sites located within the Institution nationale des invalides.
