Article L5124-9-1 of the French Public Health Code

The activities referred to in Article L. 5124-1 may be carried out by pharmaceutical establishments set up within non-profit organisations or public establishments other than health establishments:

1° When these activities concern radiopharmaceutical medicinal products ;

2° When these activities concern advanced therapy medicinal products as defined in 17° of Article L. 5121-1 and advanced therapy medicinal products as defined in Article 2 of Regulation (EC) No 1394/2007 of the European Parliament and of the Council of 13 November 2007 on advanced therapy medicinal products and amending Directive 2001/83/EC and Regulation (EC) No 726/2004.

These establishments are subject to Articles L. 5124-2, with the exception of the first paragraph, L. 5124-3, L. 5124-4, with the exception of the last paragraph, L. 5124-5, L. 5124-6, L. 5124-11 and L. 5124-18.

Article L5124-9-1

Les activités mentionnées à l’article L. 5124-1 peuvent être réalisées par des établissements pharmaceutiques créés au sein d’organismes à but non lucratif ou d’établissements publics autres que les établissements de santé :

1° Lorsque ces activités portent sur des médicaments radiopharmaceutiques ;

2° Lorsque ces activités portent sur des médicaments de thérapie innovante tels que définis au 17° de l’article L. 5121-1 et sur les médicaments de thérapie innovante définis à l’article 2 du règlement (CE) n° 1394/2007 du Parlement européen et du Conseil, du 13 novembre 2007, concernant les médicaments de thérapie innovante et modifiant la directive 2001/83/ CE ainsi que le règlement (CE) n° 726/2004.

Ces établissements sont soumis aux articles L. 5124-2, à l’exception du premier alinéa, L. 5124-3, L. 5124-4, à l’exception du dernier alinéa, L. 5124-5, L. 5124-6, L. 5124-11 et L. 5124-18.
