Title III: Conditional release

The decision granting a sentenced person the benefit of conditional release may also make the granting and continuation of this measure subject to one of the obligations and prohibitions set out in articles 131-36-2, 132-44 and 132-45 of the Penal Code.

In accordance with the provisions of the first paragraph of Article 731-1, the person is also subject, unless otherwise decided by the sentence enforcement judge or court, to a treatment order in accordance with the procedures applicable to socio-judicial follow-up, if he or she has been convicted of an offence for which this measure is incurred and a medical assessment considers that he or she is likely to undergo treatment….

In accordance with the provisions of the second paragraph of Article 731-1 et de l’article R. 61-34, adults may also be placed under mobile electronic surveillance if they have been sentenced to at least seven years’ imprisonment for an offence for which socio-judicial supervision is required. In accordance with the provisions of article R. 61-34, in the event of non-compliance by a convicted offender subject to conditional release without placement under mobile electronic surveillance, with the obligations to which he is subject, the sentence enforcement judge may order his placement under mobile electronic surveillance, without it being necessary to re-incarcerate him.

The provisions of the fourth paragraph of Article 730-2 are not applicable to foreign nationals sentenced to a penalty provided for by this article when a conditional release measure is granted to them, in accordance with the provisions of the first paragraph of Article 729-2, by being subject to the condition of a measure of prohibition from French territory, deportation or expulsion.

When the sentence enforcement court rules on an application for conditional release pursuant to the provisions of Article 730, it may make the application conditional on a measure of semi-liberty, work release or home detention under probationary electronic monitoring in accordance with the provisions of Articles 723-1 and 723-7.
