When, at the end of the negotiation period provided for in Article L. 2363-13, no agreement has been reached and the special negotiation body has not taken the decision provided for in the second paragraph of Article L. 2362-7, a European Cooperative Society Committee is set up, the establishment, powers and operating rules of which are determined in accordance with the provisions of Articles L. 2363-1 to L. 2363-7.

When, at the end of the negotiation period provided for in Article L. 2363-14, no agreement has been reached and the special negotiation body has not taken the decision provided for in the second paragraph of Article L. 2362-7, employee participation is organised in accordance with the provisions of Articles L. 2363-8 to L. 2363-10.

In the event of the transfer of the registered office of a European Cooperative Society governed by participation rules to another Member State of the European Community, employee participation rights are maintained at at least an equivalent level.
