Chapter I: PROCEDURE BEFORE THE FRENCH OFFICE FOR THE PROTECTION OF REFUGEES AND APATRIDS

When the French Office for the Protection of Refugees and Stateless Persons examines an asylum application under the accelerated procedure, it shall give its decision within fifteen days of the application being lodged.When a foreign national placed or held in detention submits an asylum application under the conditions laid down in Articles L. 754-2 and L. 754-3, it shall be examined by the Office within ninety-six hours of its receipt.

For the application of the provisions of 1° of Article L. 531-24, the persons or associations mentioned in Article L. 531-25 shall refer the matter to the Chairman of the Office’s Board of Directors by registered letter with acknowledgement of receipt. The request must include all relevant details as well as factual and legal information likely to justify the inclusion or removal of a State from the list of countries…

Decisions regarding the inclusion, removal or suspension of a State’s inclusion on the list of countries considered as safe countries of origin, on the basis of Article L. 531-25, are published in the Official Journal of the French Republic and notified by the Minister responsible for asylum to the Commission of the European Union.

When the accelerated procedure is implemented in application of article L. 531-26, the French Office for the Protection of Refugees and Stateless Persons informs the applicant of this when he is summoned for the personal interview.

When the French Office for the Protection of Refugees and Stateless Persons decides, pursuant to the fourth paragraph of Article L. 531-10 or Article L. 531-28, not to rule under the accelerated procedure, it shall inform the applicant and the competent Prefect.

Where the accelerated procedure is applied, the copy of the transcript, referred to in article R. 531-14, shall be communicated at the latest when the decision is notified. .

The decision of the French Office for the Protection of Refugees and Stateless Persons states that the decision was taken under an accelerated procedure and sets out the legal and factual reasons for this.
