Liability insurance, the purpose of which is to compensate for damage caused to third parties by the vessel and which is guaranteed under the terms of article L. 173-8, only takes effect if the sum insured by the hull policy is insufficient.
Whatever the number of events occurring during the term of the liability insurance, the sum underwritten by each insurer constitutes, per event, the limit of its commitment.
Hull insurance covers material loss and damage to the boat and its insured outbuildings resulting from all navigation accidents or events of force majeure, except where formal and limited exclusions are provided for in the insurance contract.
The insurer does not cover loss or damage if the boat undertakes the trip in a condition that makes it unseaworthy or insufficiently armed or equipped. Similarly, it does not cover loss or damage resulting from normal wear and tear or obsolescence of the boat.
The insurer is liable for the contribution of the insured goods to general average. Similarly, when the goods on board all belong to the insured, the insurer covers the losses that would have constituted general average if the goods had belonged to a third party.
The insurance covers loss of and damage to goods caused by all shipping accidents or events of force majeure, except where formal and limited exclusions are provided for in the insurance contract.
The insurer shall not be liable for damage or loss caused by intentional or inexcusable fault on the part of the consignor or the consignee as such. Hull insurance on aircraft is taken out either for a single flight or for several flights, or for a period specified in the insurance contract.
In the event of the alienation of the aircraft and the cessation of its operation, the insurance cover ceases ipso jure in respect only of the alienated aircraft from midnight on the day following the day of alienation.
