Where it appears to the pharmacist to be in the patient’s health interests to do so, the pharmacist must refuse to dispense a medicinal product. If this medicine is prescribed on a prescription, the pharmacist must immediately inform the prescriber of his refusal and indicate this on the prescription.
Whenever necessary, pharmacists should encourage their patients to consult a qualified practitioner.
Pharmacists must refrain from formulating a diagnosis of the disease in the treatment of which they are called upon to collaborate.
Pharmacists must not, by any means whatsoever, encourage their patients to abuse medicines.
All prices must be made known to the public in accordance with the economic regulations in force. Where the pharmacist is, by virtue of the regulations in force, required to freely set the prices charged in his pharmacy, he must do so with tact and moderation.
No medical or veterinary consultations may be given in the pharmacy. This prohibition also applies to pharmacists who are also doctors, dental surgeons, midwives or veterinary surgeons.
It is forbidden for a pharmacist to make all or part of his professional premises available to persons outside the pharmacy, for whatever reason, whether in return for payment or free of charge, for the practice of any other profession. Only specialised activities for which provision is made in the regulations are authorised.
The pharmacist in charge referred to in articles L. 5124-2, L. 5124-7 and L. 5142-1 must ensure compliance with professional ethics and all regulations issued in the interests of public health. The pharmacist in charge and the pharmacists under his authority must refrain from discrediting a colleague or a competitor. The pharmacist in charge must ensure that scientific, medical and pharmaceutical information and advertising are accurate and that they are used fairly. They must ensure that advertising for medicinal products is objective and not misleading.
The pharmacist in charge must check that all arrangements have been made for his replacement in the event of his absence. He must ensure that his replacement meets the required conditions.
