The same rules apply to public contracts concluded:1° in accordance with the procedure specific to an international organisation when the public contract is entirely financed by this international organisation;2° in accordance with the procedure agreed between an international organisation and the purchaser when the public contract is co-financed for the most part by this international organisation.
The rules defined in Title II shall apply to public contracts which require secrecy or the performance of which must be accompanied by special security measures in accordance with the legislative or regulatory provisions in force or for which the protection of the essential interests of the State so requires, provided that such security or protection cannot be guaranteed by other means.
The rules laid down in Title II shall apply to public service contracts concluded with a purchaser subject to this Part where the latter enjoys an exclusive right by virtue of a provision adopted by law, provided that this provision is compatible with the Treaty on the Functioning of the European Union.
