Decisions requiring people to leave French territory pursuant to Article L. 251-1 European Union citizens and their family members who benefit from the right of permanent residence provided for by article L. 234-1.
Foreign nationals whose situation is governed by this book have a period of voluntary departure of one month from notification of the decision to comply with the obligation to leave French territory.The administrative authority may only reduce the period provided for in the first paragraph in an emergency and may only extend it in exceptional circumstances.
The administrative authority may, by reasoned decision, attach to the decision imposing an obligation to leave French territory issued on the basis of 2° or 3° of Article L. 251-1 from being banned from travelling on French territory for a maximum period of three years.
The administrative authority may revoke the ban on movement on French territory at any time. When the foreign national applies to have the ban on movement on French territory repealed, his application is only admissible if he can prove that he has been residing outside France for at least one year. The sixth paragraph of Article L. 251-1 and articles L. 251-3, L. 251-7 and L. 261-1 are applicable to the ban on movement on French territory.
Decisions imposing an obligation to leave French territory and bans on movement within French territory taken pursuant to this chapter may be challenged before the administrative court under the conditions laid down in Chapter IV of Title I of Book VI. Article L. 614-5 is not applicable.
If the decision relating to the period of voluntary departure is annulled, a new decision is taken pursuant to article L. 251-3.
A foreign national whose situation is governed by this book may be subject to an expulsion order, as provided for in article L. 631-1, provided that his or her personal conduct represents a real, present and sufficiently serious threat to a fundamental interest of society. Subject to article L. 631-3 does not preclude it, a European Union citizen who has been legally resident in France for ten years may not be the subject of an expulsion order, pursuant to article L. 631-2, unless it constitutes an imperative necessity for State security or public safety.
In addition to the provisions of this title, the provisions of article L. 611-3, the second paragraph of article L. 613-3, the first sentence of article L. 613-6, Chapter IV of Title I of Book VI with the exception of those in Article L. 614-5, and articles L. 631-1 to L. 631-4, L. 632-1 to L. 632-7 and L. 641-1 to L. 641-3.
