Chapter IV: Self-employed practitioners

The participation by a hospital practitioner in an external activity of general interest for the maximum period provided for by article R. 6152-30 is exclusive of the exercise of any self-employed activity. If the duration of the general interest activity actually carried out is less than the ceiling set by the aforementioned provisions, the practitioner may be authorised to carry out a self-employed activity for an appropriately reduced period.

Non-tenured employees mentioned in 3° of article 1 of decree no. 2021-1645 of 13 December 2021 relating to teaching and hospital staff in hospitals and university centres, who are self-employed, are not entitled to the leave provided for in article 95 of the same decree.

Practitioners who choose to collect their fees directly provide the director of the public health institution with a summary statement of their self-employed activity, which is required to calculate the fees they must pay in application of article L. 6154-3. When a patient treated as a self-employed practitioner is admitted to hospital, his or her accommodation costs are calculated, depending on the scheme chosen, in accordance with the tariff provisions normally applicable.

For any procedure or consultation, a patient who chooses to be treated as a self-employed practitioner is given, in advance, full details of the rules that will apply to him as a result of his choice. In the event of hospitalisation, they must expressly state in writing their choice to be treated as a private practitioner. The provisions of article R. 1112-23 are applicable in all public health establishments.

The proportion of the technical package mentioned in the last paragraph of Article L. 6154-3 is set at 20% of its amount.
