The procedures for expressing refusal as defined in article R. 1232-4-4 are the subject of public information provided by the Agence de la biomédecine.
The automated national register instituted by Article L. 1232-1 shall be operated and managed by the Agence de la biomédecine under the conditions laid down in this section.
Any person of full age or a minor of at least thirteen years of age may be entered on the register in order to make known their refusal to have organs removed from their body after their death, either for therapeutic purposes, or to investigate the cause of death, or for other scientific purposes, or in more than one of these three cases. Applications for inclusion on the register are made on plain paper or by filling in the form made available to the public by the Agence de la biomédecine. A certificate of registration on the register will be sent to the applicant as soon as their registration is recorded, unless they expressly state that they do not wish to receive a certificate.
A refusal to take a sample may be revoked at any time by the person concerned, under the same conditions as those laid down for the application for registration by article R. 1232-7. A certificate of removal from the register is sent to the person concerned, unless they expressly state that they do not wish to receive a certificate.
Without prejudice to the provisions of article L. 1232-2 concerning minors, no organs may be removed from a deceased person over the age of thirteen for therapeutic purposes, or to investigate the cause of death, or for other scientific purposes, without the register first being asked whether the deceased person has refused to have the organs removed.
The request to consult the register is made by the director of the health establishment in which the removal is planned or, failing this, by another official of the establishment expressly authorised for this purpose by the director. The request must be accompanied by a copy of the death certificate provided for in article R. 1232-3.
The response to the request to query the register is sent by an official of the Agence de la biomédecine expressly authorised for this purpose by the Director General of this establishment.
