Any establishment or service managed by an association bringing together the holders of parental authority or legal representatives of the children cared for and whose purpose is the non-permanent care of young children has the status of a parent-managed establishment or service. I.-In parent-managed establishments or services, the person exercising the management functions provided for in article R. 2324-34 is called the “technical manager”. In parent-run establishments or services, the obligations to carry out criminal record checks on staff set out in article R. 2324-33 apply to the holders of parental authority or legal representatives of children participating in the care of the latter, as well as to the management of staff.

In parent-run establishments or services, the participation of the holders of parental authority or legal representatives in the care of children is taken into account when applying the staffing rules set out in I of article R. 2324-43. For the application of articles R. 2324-43-1 and R. 2324-43-2, one of the two professionals required may be replaced by a person with parental authority or a child’s legal representative.

The voluntary activities of members of an association managing a parent-run establishment or service are included in the activities that can be taken into account for the citizen commitment account under the conditions mentioned in 6° of article L. 5151-9 of the Labour Code.
