Article R6152-52 of the French Public Health Code

The secondment on request or its renewal is granted by the Director General of the National Management Centre, after obtaining the opinion of the head of the department, the head of the service, the chairman of the establishment’s medical committee and the director of the establishment in which the person concerned is working for the initial request and its first renewal. These opinions are not required for subsequent renewals.

Article R6152-55 of the French Public Health Code

In the cases provided for in 2°, 4°, 6° and 8° of article R. 6152-51, the practitioner may not obtain a secondment before three years of service in his post. Only hospital practitioners appointed on a permanent basis may benefit from the secondment provided for in 5° of the aforementioned article. The request for secondment must be submitted by the practitioner at least two months in advance.

Article R6152-58 of the French Public Health Code

The secondment is granted for a maximum period of five years and may be renewed under the same conditions. When the period of secondment exceeds six months, the post is declared vacant, except in the case provided for in 3° of article R. 6152-51, for which the post is declared vacant when this period exceeds one year.

Candidates appointed as university hospital practitioners, pursuant to article 82 of decree no. 2021-1645 of 13 December 2021 relating to teaching and hospital staff at university hospitals, are simultaneously appointed and established as hospital practitioners. Article R6152-61 of the French Public Health Code

At the end of their secondment and if they have not been appointed to a teaching and hospital staff corps, they are reinstated in a hospital practitioner post under the conditions provided for in 3° of article R. 6152-7. Where applicable, they are placed on compulsory leave for the period between the end of their secondment as a university hospital practitioner and their reinstatement in the body of hospital practitioners.

Article R6152-62 of the French Public Health Code

Hospital practitioners may be placed on standby either automatically, in the cases provided for in articles R. 6152-37 to R. 6152-39, R. 6152-42, R. 6152-50-5, R. 6152-59, R. 6152-61 and R. 6152-68, or at their request. Hospital practitioners who are temporarily banned from practising the profession of doctor, pharmacist or from providing care to the socially insured are placed on compulsory leave for the duration of this ban.
