Title I: Provisions applicable in French Polynesia, the Wallis and Futuna Islands and New Caledonia

The powers vested in the competent public accountant by Article 707 shall be exercised by the officer responsible for the recovery of fines under the regulations applicable in the territory.

The persons referred to in article 714 may be detained in premises other than a prison.

Notwithstanding the provisions of the second and third paragraphs of article 712-2, the President of the Court of First Instance of Wallis and Futuna performs the duties of a sentence enforcement judge. He shall exercise the powers devolved to the sentence enforcement court in accordance with the provisions of the second paragraph of Article 712-3.

In New Caledonia, where the convicted person is a minor, the service responsible for the judicial protection of children or its director carries out the duties devolved, as appropriate, to the prison probation service or its director.

For the application of Article 719 in the Wallis and Futuna Islands, French Polynesia and New Caledonia, journalists are either holders of the professional identity card defined by the Labour Code, or are recognised as journalists under the provisions having the same purpose in these collectivities.

The surety referred to in article 759 shall be admitted by the competent public accountant or by the agent who exercises the functions devolved to the latter by the regulations applicable to the territory.

Article 763 reads as follows: “Art. 763.-In the event that a sentence handed down in a criminal case is time-barred, the convicted person is automatically and permanently subject to a ban on residence in the district or administrative subdivision where the victim of the crime or their direct heirs live. “

The first paragraph of Article 763-7 reads as follows: “When a person sentenced to socio-judicial supervision including a treatment order is to undergo a custodial sentence, he or she will serve this sentence in a prison that can provide appropriate medical and psychological supervision. “
