At the latest before the contract is awarded, the candidate must produce any document certifying that it has not been excluded from participating in the procedure for awarding concession contracts provided for in articles L. 3123-1 to L. 3123-14.
To prove that it has fulfilled the obligations set out in article L. 3123-2, the candidate shall produce a certificate issued by the competent administrations and bodies. The list of taxes, levies, contributions or social security contributions for which a certificate must be issued and the list of competent administrations and bodies are set out in an order of the Minister for the Economy appended to this code.
If the candidate relies on the capacities and abilities of other economic operators, it must provide evidence of the capacities and abilities of these economic operators and prove that it will have them throughout the performance of the contract. Before examining the applications, the concession-granting authority which finds that documents or information are missing which must be produced in accordance with the provisions of articles R. 3123-1 to R. 3123-8 and articles R. 3123-16 to R. 3123-19 may ask the applicants concerned to complete their application file within an appropriate period of time. It shall then inform the other applicants of the implementation of this provision.
The following shall not be admitted to participate in the rest of the procedure for awarding the concession contract: 1° Candidates who submit an incomplete application, where applicable after implementation of the provisions of article R. 3123-20, or one containing false information or documents; 2° Candidates who submit an inadmissible application.
When the conceding authority makes use of the possibility to negotiate provided for in article L. 3121-1, it may decide to limit the number of tenderers admitted to take part in the negotiation. Where tenders can only be submitted following a visit to the place where the contract is to be performed or after on-the-spot consultation of additional documents, the time limit for the receipt of tenders shall be set in such a way as to allow the economic operators concerned to acquaint themselves with the information necessary for the submission of their tender.
