Book V: Combating smoking and doping

Article L. 3335-1 applies to premises selling manufactured tobacco, without prejudice to acquired rights. By way of derogation from article L. 3335-1 and without prejudice to acquired rights, a tobacconist’s shop may not be established around a public educational establishment, a private educational establishment or a youth training or leisure establishment at a distance of less than a threshold set by order of the State representative in the département.

The sale of tobacco products from vending machines is prohibited.

It is forbidden to sell or offer free of charge tobacco products as defined in article L. 3512-1 or ingredients as defined in article L. 3512-2 to minors under the age of eighteen in tobacconists and any other shops or public places. The person issuing one of these products requires the customer to provide proof of his or her majority.

The manufacture, sale, distribution or offer free of charge of products intended for oral use, with the exception of those intended to be smoked or chewed, consisting wholly or partly of tobacco, in the form of powder, fine particles or any combination of these forms, in particular those presented in portioned sachets or porous sachets, or in a form resembling an edible foodstuff, is prohibited.

It is prohibited to sell, distribute or offer free of charge packets of fewer than twenty cigarettes and packets of more than twenty cigarettes that do not consist of a number of cigarettes that is a multiple of five, as well as containers of fewer than thirty grams of fine-cut tobacco intended for the rolling of cigarettes and containers of more than thirty grams of fine-cut tobacco intended for the…
