Automatic financial aid is granted to support the promotion of cinematographic works abroad.
The award of financial aid for the promotion abroad of cinematographic works is subject to the provisions of Commission Regulation (EU) No 651/2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the Treaty, in particular those provided for in Chapter I and Article 54 of Section 11 relating to aid schemes for audiovisual works.
The beneficiaries of aid for the promotion of cinematographic works abroad are foreign sales companies which, as assignees or agents, have exploitation rights for the marketing of cinematographic works abroad.
To be eligible for aid for the promotion of cinematographic works abroad, companies must meet the following conditions:1° Be established in France;2° Have chairmen, directors or managers, as well as the majority of directors who are French nationals or equivalent;3° Not be controlled by one or more natural or legal persons who are nationals of States other than European States, when they are set up in the form of commercial…
Foreign sales companies have exploitation rights for the marketing abroad of at least three feature-length cinematographic works for which production approval has been granted, for all modes of distribution, on the territory of at least fifteen States and for a minimum duration of twenty-four months. These rights must be effectively implemented, in particular through sales, market presence and promotional tools.
The following are eligible for aid to promote cinematographic works abroad:1° Long-length cinematographic works for which investment approval has been granted at the time the application is submitted, subject to production approval having been granted;2° Long-length cinematographic works for which production approval has been granted for less than four years at the time the application is submitted;3° Cinematographic works for which aid for world cinemas has been granted and whose…
The management of foreign exploitation rights for cinematographic works, in particular the signing of sales contracts and the collection of the corresponding royalties, is carried out by corporate officers or employees working within the stable and permanent establishment in France of the foreign sales company.
The total amount of aid for the promotion of cinematographic works abroad may not exceed 50% of the expenditure incurred by the foreign sales company.
Exceptions to the 50% threshold may be granted by the President of the Centre national du cinéma et de l’image animée, up to a limit of 60% and upon a reasoned request from the foreign sales company, for difficult or low-budget cinematographic works.A difficult work is a director’s first or second work. A low-budget work is one whose final production cost is less than or equal to €1,250,000.
Automatic financial support for the promotion of cinematographic works abroad gives rise to the allocation of investment grants.
