Section 2: Types of practice

Salaried commercial court registrars are subject to the legislative and regulatory provisions relating to the exercise of the functions of commercial court registrar by natural persons, to the ethics and discipline of commercial court registrars and to the provisions of this sub-section.

Unless they are employed by a clerk of several commercial courts, salaried commercial court clerks may only carry out their duties within a single office. They may carry out the tasks devolved to commercial court clerks with the exception of those relating to assisting the president of the commercial court in the tasks of administration, organisation and management of the court. .

The salaried commercial court clerk invested with a mandate in the Conseil national des greffiers des tribunaux de commerce may not participate in deliberations or votes on disciplinary matters concerning the titular clerk of the office or the associated clerks exercising their functions within the titular company of the office in which he is employed. The holder of the office is civilly liable for the professional activity carried out on its behalf by the salaried clerk.

Any plan to recruit a salaried court clerk is brought to the attention of the Minister for Justice, the Keeper of the Seals, by tele-procedure on the website of the Ministry of Justice.
