Chapter I: The investigating judge: court of first instance

The notice of the end of information sent to the parties pursuant to I of Article 175 shall include a statement informing them of their right to request, if they have not already done so, and in accordance with the procedures set out in the penultimate paragraph of Article 81, to exercise one or more of the rights provided for in IV and VI of Article 175.

If a party has requested to exercise one or more of the rights provided for in IV and VI of Article 175, the relevant provisions of IV and VI of that Article shall apply to all the parties.

When the public prosecutor’s final indictment sent to the examining magistrate pursuant to II of Article 175 has not been copied to the parties’ lawyers, the examining magistrate’s clerk or the joint secretariat of the investigation shall proceed with this dispatch. This dispatch may be made by electronic means of communication in accordance with the procedures set out in Article 803-1.

The observations, requests for action and additional observations provided for in IV and VI of Article 175 shall be sent to the investigating judge in accordance with the procedure laid down in the penultimate paragraph of l’article 81.
