The members of the restricted formation of the departmental commission for inter-communal cooperation are elected for the duration of their term of office on this commission. When a seat becomes vacant on the select committee, it is filled under the conditions set out in article R. 5211-31, within one month of the vacancy occurring.
The restricted formation of the departmental commission for inter-municipal cooperation is chaired by the prefect and the general rapporteur of the departmental commission for inter-municipal cooperation assumes the same functions within this formation. When the public establishment for inter-municipal cooperation from which a commune applies to withdraw includes the commune of Paris, the restricted formation of the competent departmental commission for inter-municipal cooperation is completed by two representatives of the commune of Paris, appointed by the Paris council from among its members.
The provisions of articles R. 5211-36 to R. 5211-40 apply to the plenary formation and the restricted formation of the departmental commission for intermunicipal cooperation.
The Prefect convenes the Departmental Commission for Intercommunal Cooperation. The notice is sent to the members of the relevant panel in writing and at their home addresses at least five days before the day of the meeting, accompanied by the agenda and an explanatory report for each item on the agenda. The Commission départementale de la coopération intercommunale may only validly deliberate if the number of members present is at least equal to half of the serving members of the panel. If this number is not reached, a new convocation is sent under the conditions provided for in article R. 5211-36. The committee may then deliberate regardless of the number of members present.
