Decisions of the Disciplinary Board are made by a panel, subject to exceptions, specified by decree in the Conseil d’Etat, relating to the subject matter of the referral or dispute or the nature of the issues to be examined or decided. They may be rendered by a restricted panel.

Sanctions pronounced by the disciplinary chambers of the regional councils of section A and by those of the central councils of sections B, C, D, E, G and H may be appealed to the disciplinary chamber of the Conseil national de l’ordre des pharmaciens. The appeal has suspensive effect.

The decisions of the Disciplinary Board of the National Council may be appealed to the Conseil d’Etat. When the Disciplinary Board of the National Council imposes a ban on practising the profession, it sets the starting date of the ban. Decisions of the National Disciplinary Board are rendered in collegial formation, subject to exceptions, specified by decree in the Conseil d’Etat, relating to the subject of the referral or dispute or the nature of the issues to be examined or judged. They may be rendered in a restricted formation.

A pharmacist may, on application to the national council, be relieved by it after a period of five years of the incapacity resulting from a conviction which has led to permanent removal from the roll.

When the various councils rule on disciplinary matters, the State representatives mentioned in articles L. 4231-4 and L. 4232-6 to L. 4232-15 do not sit on these bodies.
