Title II: Apprenticeship contract

Legal persons governed by public law whose employees are not subject to private law may enter into apprenticeship contracts in accordance with the terms and conditions set out in this Title, subject to this Chapter. Unincorporated public bodies may, provided they have the legal capacity to recruit staff, enter into apprenticeship contracts under the same conditions as those set out in the first paragraph.

Notwithstanding article L. 6222-7, the apprenticeship contract is concluded for a limited period.

The legal entities referred to in Article L. 6227-1 may enter into agreements with another legal entity governed by public law or with a company whereby part of the practical training is provided by this other legal entity governed by public law or by this company. A decree lays down the clauses to be included in these agreements and the other provisions applicable to them.

The general conditions for the reception and training of apprentices are the subject of an opinion from the Technical Committee or any other competent body on which staff representatives sit. This body examines an annual report on the performance of apprenticeship contracts.

For the implementation of this chapter, an apprentice training centre may enter into an agreement with one or more training centres managed by a person referred to in article L. 6227-1 or with the Centre national de la fonction publique territoriale, under the terms of which these establishments provide some of the training normally provided by the apprentice training centre and may make teaching or accommodation facilities available to it….

The legal entities mentioned in article L. 6227-1 cover the costs of training their apprentices in the apprentice training centres that take them on, except where these legal entities are liable for the apprenticeship tax. To this end, they enter into an agreement with these centres to define the terms and conditions of this assumption of responsibility.

The apprentice is affiliated to the general social security scheme for all risks and to the supplementary pension scheme set up for the benefit of non-tenured employees of the State and local authorities or for the benefit of employees of the other legal entities governed by public law mentioned in article L. 6227-1. The apprentice’s employer is exempt from all statutory and collective bargaining social security contributions payable by the apprentice, with the exception of those payable in respect of accidents at work and occupational illnesses.

The State will pay the social insurance contributions and family allowances payable by the employer, as well as the statutory and contractual employee contributions and contributions made compulsory by law in respect of wages paid to apprentices, including the unemployment insurance contributions paid by the employer who has joined the scheme referred to in article L. 5422-13. By way of derogation, this membership may be limited to apprentices.

The services completed by the apprentice under his apprenticeship contract(s) may neither be taken into account as public service within the meaning of the provisions applicable to civil servants, public employees or employees of the legal entities mentioned in article L. 6227-1, nor under one of the special retirement schemes applicable to these employees.
