Book II: Combating illegal employment

Infringements of the prohibitions on undeclared work set out in Article L. 8221-1 are investigated by the officials mentioned in Article L. 8271-1-2.

Infringements of the prohibition on undeclared work are recorded in official reports, which are valid until proven otherwise. These reports are sent directly to the public prosecutor.

For the purposes of investigating and establishing breaches of the prohibition on undeclared work, inspection officers may ask to see and obtain immediate copies of the following documents, regardless of their form or medium: 1° Documents proving that the registration, declarations and formalities referred to in articles L. 8221-3 and L. 8221-5 have been carried out, as well as those relating to the authorisation to practise the profession or to…

Upon written request, control officers may obtain from the prefectoral services any information or documents relating to the authorisation to practise or the approval of a regulated profession.

Where a company’s registered office is located in jointly occupied premises, in accordance witharticle L. 123-10 of the French Commercial Code, which punishes certain offences relating to the register of companies and businesses, the inspection officers are entitled to obtain from the registered office any documents held on the company’s premises that are necessary for them to carry out their task of combating undeclared work.
