When a natural person carries out canvassing activities on behalf of a legal entity authorised under the conditions set out in I of article L. 341-4, the legal entity issues the canvassing licence provided for in article L. 341-8.

If canvassing activity ceases for any reason whatsoever, the holder of the card issued pursuant to article L. 341-8 must return the card immediately.

The file set up under article L. 341-7 is entitled “the direct marketers’ file”. In particular, it enables persons canvassed under the conditions defined in article L. 341-1 to ensure that the persons requesting their services are qualified as canvassers.

The database of direct marketers is maintained by the Banque de France on behalf of the authorities referred to in Article L. 341-7 . The procedures for managing the file and the relations between the Banque de France and the authorities concerned are set out in an agreement. The information contained in the direct seller file is as follows: 1° The direct seller’s registration number; 2° The name, surname, first names, date and place of birth of the direct seller, natural person; 3° The business address of the direct seller; 4° The name, address and, if applicable, SIREN number of the legal entity or entities falling within one of the categories mentioned in 1° and 3° of Article…

Pursuant to II of article L. 341-4, the renewal of a direct seller’s contract must be declared no later than five days before its expiry date. Pursuant to the third paragraph of article 38 of law no. 78-17 of 6 January 1978 on data processing, data files and individual liberties, the right to object does not apply to the file provided for in article D. 341-9.

The rights of access and rectification provided for respectively in articles 39 and 40 of the aforementioned Act of 6 January 1978 may be exercised with the Banque de France and the persons having appointed or mandated the direct marketers.
