The activity and employment cooperative is responsible for the commitments made to third parties in the context of the economic activity developed by the associated employee entrepreneur.
The industrial tribunal has sole jurisdiction to hear disputes relating to the contract referred to in 2° of Article L. 7331-2. Any clause conferring jurisdiction included in a contract concluded between an associate salaried entrepreneur and a cooperative for activity and employment of which he is a member is null and void.
This Title applies to salaried entrepreneurs governed by Articles L. 7331-2 and L. 7331-3 who are not yet members of the cooperative of activity and employment.
This Title applies to self-employed persons who use one or more electronic contact platforms as defined inArticle 242 bis of the General Tax Code in order to carry out their professional activity.
Where the platform determines the characteristics of the service provided or the good sold and sets its price, it shall have a social responsibility towards the employees concerned which shall be exercised in accordance with the conditions laid down in this Chapter.
When the employee takes out insurance covering the risk of accidents at work or joins the voluntary insurance scheme for accidents at work mentioned in article L. 743-1 of the Social Security Code, the platform will pay the employee’s contribution, up to a ceiling set by decree. This ceiling may not exceed the contribution provided for in the same article L. 743-1. The first paragraph of this Article shall not…
The worker benefits from the right of access to continuing vocational training provided for in Article L. 6312-2. The contribution to vocational training mentioned in article L. 6331-48 is paid by the platform. At their request, they may benefit from the actions mentioned in 3° of Article L. 6313-1. The platform will then cover the costs of the support and pay the worker an allowance under conditions defined by decree….
Article L. 7342-2 and the first two paragraphs of article L. 7342-3 do not apply when the turnover generated on the platform is below a threshold set by decree. For the purposes of calculating the contribution relating to accidents at work and the contribution to vocational training, only the turnover generated by the worker on the platform is taken into account.
Movements of concerted refusal to provide their services organised by the workers referred to in Article L. 7341-1 with a view to defending their professional claims may not, except in the case of abuse, give rise to contractual liability on their part, constitute grounds for terminating their relations with the platforms, or justify measures penalising them in the exercise of their activity.
The workers referred to in Article L. 7341-1 have the right to form and join a trade union and to represent their collective interests through it.
