Title III: Termination of open-ended employment contracts

The information and documents intended for the employee representatives provided for in Article L. 1233-48 are sent by electronic means simultaneously to the Regional Director of Companies, Competition, Consumption, Labour and Employment. Information and documents intended for the central social and economic committee, in application of article L. 1233-51, are sent by electronic means to the regional director of companies, competition, consumption, labour and employment at the head office.

In companies with fewer than fifty employees, the employer shall notify the Regional Director of Companies, Competition, Consumption, Labour and Employment of any changes made to the measures provided for in Article L. 1233-32 and to the timetable for their implementation.

In the event of safeguard proceedings, the employer or administrator sends a copy of the judgment referred to inarticle L. 626-11 of the Commercial Code to the regional director of companies, competition, consumption, labour and employment. In the event of receivership or compulsory liquidation, the employer, administrator or liquidator sends a copy of the receivership or compulsory liquidation judgment to the regional director of companies, competition, consumption, labour and employment.

When there is no social and economic committee in the company, the information mentioned in article L. 1233-31, the job protection plan and the information provided for in 1° of article R. 1233-6 are sent by electronic means to the regional director of companies, competition, consumption, work and employment at the same time as the notification of the redundancy project provided for in article L. 1233-46.

If there is no social and economic committee, as a result of a failure to act recorded under the conditions provided for in article L. 2314-9, the employer shall attach to the notification of the proposed redundancies the report of the failure to act drawn up in accordance with these articles and send it by electronic means.
