The same penalties shall apply to assisting in obtaining human embryos in return for payment, in whatever form, or handing over human embryos to third parties for payment. “

As stated in Article 511-16 of the French Penal Code, reproduced below: “Obtaining human embryos without complying with the conditions set out in Articles L. 2141-5 and L. 2141-6 of the Public Health Code is punishable by seven years’ imprisonment and a fine of €100,000. “

As stated in article 511-22 of the French Penal Code, reproduced below: “The act of carrying out medically assisted procreation activities without having obtained the authorisation provided for in the fourth paragraph of article L. 2142-1 of the Public Health Code or without complying with the prescriptions of the latter is punishable by two years’ imprisonment and a fine of 30,000 euros. “

As stated in Article 511-23 of the Criminal Code, reproduced below: “Introducing human embryos into the territory where the Public Health Code applies or removing them from this territory without the authorisation provided for in Article L. 2141-9 of the Public Health Code is punishable by three years’ imprisonment and a fine of 45,000 euros. “

As stated in article 511-24 of the French Penal Code , reproduced below: “The act of carrying out medically assisted procreation activities for purposes other than those defined in article L. 2141-2 of the Public Health Code is punishable by five years’ imprisonment and a fine of 75,000 euros. “
