Article D7121-44 of the French Labour Code

The contribution paid by the employer affiliated to the paid leave fund is determined by a percentage of the amount of wages and salaries paid to the staff concerned. The internal regulations of the fund determine the percentage, the periods and methods of payment of the contributions as well as the supporting documents required for such payment. The employer shall inform the caisse de congés payés of the family allowance fund to which it belongs. It provides proof, in the form of documents issued by the paid leave fund, on a quarterly basis and more often if necessary: 1° Of the rate of compensation applied to it; 2° That it is up to date with its obligations towards the paid leave fund.

A joint committee is set up within the paid leave fund. It is responsible for: 1° Monitoring the operation of the fund with regard to the allocation of holiday pay to beneficiaries; 2° Ruling on any disputes that may arise concerning entitlement to holiday pay.

Article D7121-49 of the French Labour Code

The Joint Committee is made up of equal numbers of employers’ and employees’ representatives. These representatives are appointed respectively by the professional organisations which are representative at national level of the companies and professions for which the fund is approved. In the event of a dispute as to which organisations are representative, the Minister for Labour will give a ruling under the conditions set out in Article L. 2121-2.
