Chapter II: Organisation and operation of regional health agencies

Notwithstanding decree no. 82-453 of 28 May 1982 relating to health and safety at work and medical prevention in the civil service, the provisions of Title II of Book VI of Part IV of the regulatory part of the Labour Code are applicable to civil servants and public-sector contract workers performing their duties in a regional health agency, with the exception of articles R. 4624-10 to R. 4624-15.

The provisions set out in articles R. 4624-19 and R. 4624-20 of the Labour Code are applicable to civil servants, practitioners mentioned in 1° of article L. 6152-1 and public sector contract workers who carry out their duties in a regional health agency when they are reinstated after long-term sick leave, long-term leave or serious sick leave or when they suffer from specific pathologies determined by the occupational physician.

The medical file of civil servants and contractual employees under public law is compiled by the occupational physician from the time they take up their post within the regional health agency.

A health and safety inspector will work in the agency under the conditions set out in decree no. 82-453 of 28 May 1982 on health and safety at work and medical prevention in the civil service. The Labour Inspectorate may be contacted under the conditions set out in articles 5-4 to 5-7 of the same decree.

A health and safety officer is appointed by the agency director. He/she works in the agency under the conditions laid down by decree no. 82-453 of 28 May 1982 on health and safety at work and medical prevention in the civil service. At the initiative of the occupational physician, this agent is involved in the work of drawing up the company file.
