The conditions to which the possibility of benefiting from promotional offers as well as that of taking part in competitions or promotional games are subject, when these offers, competitions or games are offered by electronic means, are clearly specified and easily accessible.
The provisions of articles L. 122-8 and L. 122-9 are applicable to advertising, offers, competitions or games aimed at professionals.
Where advertisements, whatever their medium, present products subject to European energy labelling by indicating their selling price, they shall include the mention of the energy class of these products in a way that is as visible, legible and intelligible as the indication of their selling price.
For the purposes of this sub-section, infant formulae are foodstuffs intended for the feeding of children up to the age of four months and presented as meeting, on their own, all their nutritional requirements. .
Advertising for infant formula is only permitted in the written press aimed at healthcare professionals.
It shall be prohibited in the retail trade to distribute samples of infant formula free of charge or to engage in any other promotional practice in favour of the direct sale of such formula.
Manufacturers and distributors are prohibited from providing infant formulae, samples of these products or any other promotional gifts to the public free of charge, whether directly or indirectly through health services or their agents.
The detailed rules for the application of this subsection are laid down by decree in the Conseil d’Etat.
