In the case of an overall contract for the construction and operation or maintenance of a work, the remuneration for operation or maintenance services may not contribute to the payment for the construction.
Contracts may provide for a guarantee deduction, a first demand guarantee or a personal and joint guarantee to be payable by the contractor, under the conditions and subject to the exceptions provided for by decree in the Conseil d’Etat.
The holder of a contract may assign its claim on the purchaser to a credit institution or another assignee.The holder of a contract may pledge its claim on the purchaser to a credit institution or another creditor.
Holders of contracts concluded with the State, local authorities and public establishments, as well as their subcontractors eligible for direct payment, send their invoices in electronic form.
The State, local authorities and public establishments accept invoices sent in electronic form by the holders of contracts mentioned in article L. 2192-1 and their subcontractors eligible for direct payment.
Without prejudice to Article L. 2192-2, purchasers shall accept invoices that comply with the electronic invoicing standard defined by regulation and that are sent in electronic form by contract holders and their subcontractors eligible for direct payment.
The detailed rules for the application of this sub-section, in particular the compulsory information that electronic invoices must contain, shall be defined by regulation.
A shared solution, made available by the State and known as the “public invoicing portal”, enables invoices to be submitted, received and transmitted in electronic form. To implement the obligations laid down in sub-section 1 of this section, the following shall use the public invoicing portal: 1° The State, local authorities and public establishments; 2° The holders of contracts concluded with a purchaser mentioned in 1° as well as their…
This sub-section does not apply to invoices issued in performance of contracts awarded by: 1° The State and its public establishments in the event of national defence or security imperatives; 2° The Caisse des dépôts et consignations; 3° The public establishment mentioned inArticle L. 2142-1 of the Transport Code; 4° SNCF, SNCF Réseau and SNCF Voyageurs.
Detailed rules for the application of this subsection shall be laid down by regulation.
