Book VI: REMOVAL DECISIONS

Subject to the provisions of article L. 622-2, the administrative authority may, by reasoned decision, attach to the surrender decision taken pursuant to article L. 621-1 against a foreign national holding a residence permit in the State to whose authorities he is to be surrendered, a travel ban on French territory of up to three years.

The decision to surrender a foreign national in the cases provided for in articles L. 621-4, L. 621-5, L. 621-6 and L. 621-7 may only be accompanied by a ban on movement within French territory if the foreign national’s residence in France constitutes an abuse of rights or if the foreign national’s personal conduct represents, with regard to public order or public security, a real, current and sufficiently serious threat…

The imposition and duration of the travel ban provided for in article L. 622-1 are decided by the administrative authority, taking into account the length of time the foreign national has been present on French territory, the nature and length of their ties with France, whether or not they have already been subject to a removal order and the threat to public order posed by their presence on French territory.

The administrative authority may revoke the driving ban provided for in article L. 622-1 at any time.When the foreign national applies to have the driving ban revoked, his application is only admissible if he can prove that he has been residing outside France for at least one year.
