In the absence of the agreement referred to inArticle L. 3142-129, in companies with three hundred employees or more, the percentage of employees referred to inArticle L. 3142-127 is set at 2% of the company’s total workforce.
In the absence of the agreement referred to inArticle L. 3142-129, in undertakings with fewer than three hundred employees, the level provided for inArticle L. 3142-128 is set at 2% of the total number of hours worked during the year.
Failure to comply with the provisions of articles L. 3141-1 to L. 3141-33 and L. 3164-9 relating to paid leave, as well as those of the decrees issued for their application, is punishable by a fifth-class fine, imposed as many times as there are employees affected by the offence. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Penal Code.
Failure to comply with the provisions of articles L. 3142-54 to L. 3142-59 relating to training leave for managers and youth workers and the decrees issued for their application is punishable by a third-class fine.
Failure to comply with the provisions of articles L. 3142-36 to L. 3142-41, relating to mutual training leave, as well as those of the decrees issued for their application, is punishable by a third-class fine.
Failure to comply with the provisions of articles L. 3142-95, L. 3142-96 and D. 3142-62 relating to national service is punishable by a fifth-class fine. Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Criminal Code.
