TITLE II: BODIES OF THE TERRITORIAL COLLECTIVITY OF MARTINIQUE

The President of the Assembly of Martinique or the Vice-Presidents, the President of the Executive Council or the Executive Councillors who, for the duration of their term of office, have ceased to exercise their professional activity and do not acquire any pension rights under a compulsory old-age insurance scheme are affiliated to the old-age insurance scheme of the general social security scheme.

Councillors to the Martinique Assembly and members of the Executive Council other than those referred to in Article L. 7227-29 may set up an annuity pension scheme in the management of which the affiliated elected representatives must participate. The annuity pension scheme is half funded by the elected representative and half funded by the territorial authority of Martinique. A Conseil d’Etat decree sets the contribution rate ceiling.

Councillors to the Assembly of Martinique and members of the Executive Council shall be affiliated to the supplementary pension scheme instituted for the benefit of non-tenured public authority employees. Pensions paid pursuant to this article shall be cumulative without limitation with any other pension or retirement. .

For the application of articles L. 7227-29 to L. 7227-31, the contributions of the territorial collectivity of Martinique and those of its elected representatives are calculated on the amount of compensation actually received by the latter pursuant to section 3 of this chapter or any other text governing the compensation of their functions. The contributions of elected representatives are personal and compulsory.

Retirement pensions already liquidated and rights acquired before 30 March 1992 continue to be honoured by the institutions and bodies with which they were constituted or from which they were transferred. The corresponding expenses are covered, where applicable, by a balancing subsidy paid by the local authorities concerned.
