BOOK II: NATIONAL BODIES RESPONSIBLE FOR LOCAL AUTHORITIES AND THEIR GROUPINGS

The ten representatives of the municipalities and their alternates are elected by the College of French Mayors, by a one-round majority list ballot, with complete lists submitted, without adding or deleting names and without changing the order of presentation. No candidate may appear on more than one list representing different categories of territorial authorities or public establishments of inter-municipal cooperation with their own tax status.

Candidate lists shall be lodged with the ministry responsible for local and regional authorities on a date set by order of the minister responsible for local and regional authorities. This order also sets the deadline for sending or depositing ballot papers with the secretariat of the census commission provided for in article R. 1213-12, at the Prefecture or the High Commission of the Republic.

The organisation of the ballots mentioned in articles R. 1213-2 to R. 1213-5 is not required if a single list of candidates, complying with the provisions of these articles and of article R. 1213-6, is filed with the Ministry responsible for local authorities.

The election of the representatives of the regions and the Corsican collectivity shall take place by means of ballot papers sent by registered post or lodged against receipts with the secretariat of the census commission provided for in Article R. 1213-12.

The election of the representatives of the départements shall take place by means of ballot papers sent by registered post or handed in against receipts to the secretariat of the census commission provided for in article R. 1213-12.

The election of the representatives of the public establishments of intercommunal cooperation with their own tax status and of the communes takes place by ballot papers sent by registered letter or deposited against receipts at the prefecture or the high commission of the Republic. Each ballot paper is placed in a double envelope. The outer envelope shall bear the words “Election of the members of the National Standards Assessment Board”, an indication of the electoral college to which the voter belongs, his or her name, position and signature.

A central census commission is set up under the minister responsible for local and regional authorities. It is chaired by a Conseiller d’Etat appointed by the Vice-President of the Conseil d’Etat and includes a representative of the Minister responsible for local authorities and three representatives of national associations of local elected representatives, appointed by the Minister responsible for local authorities.

If, on the date mentioned in the first paragraph of Article R. 1213-7, a single list of candidates is submitted for one of the ballots mentioned in articles R. 1213-2 to R. 1213-5, the central census commission verifies that the list complies with the applicable provisions and decides whether or not to organise the ballot pursuant to the provisions of Article R. 1213-7-1.
