Chapter II: Organisation and operation of regional health agencies

I. – In addition to the representative of the State in the region who chairs it, the Supervisory Board comprises the following members who have the right to vote: 1° Three representatives of the State: a) The rector of the academic region or his representative ; b) The regional director of youth, sports and social cohesion or, where appropriate, the regional and departmental director of youth, sports and social cohesion…

The following may participate in the work of the Supervisory Board in an advisory capacity: 1° The accounting officer ; 2° The regional director of public finance or, for the Ile-de-France region, the budget and accounts controller of the Ministry of Health; 3° The chairman of the regional conference on health and autonomy.

The members of the Supervisory Board are appointed by order of the ministers responsible for health, health insurance, the elderly and the disabled. These ministers may, by order published in the Journal officiel de la République française, authorise the secretary general of the ministries responsible for social affairs to sign the appointment orders on their behalf. If, during his or her term of office, a member of the Supervisory Board falls under one of the incompatibilities or incapacities provided for in II of article L. 1432-3 of this code, his or her duties shall be terminated by a joint order of the ministers responsible for health, health insurance, the elderly and the disabled.

Any member who loses the capacity for which he was appointed ceases to be a member of the Supervisory Board. If a member ceases to be a member of the Supervisory Board on which he or she sat, a new member is appointed within three months, under the same conditions, for the remainder of the term of office.
