TITLE I: Judicial administrators, judicial representatives and business diagnostics experts.

Under the provisions of Article L. 812-3, benefit from exemption from the examination for admission to the traineeship :

The duration of the traineeship is at least three years and at most six years. The traineeship consists of the practice of activities enabling the acquisition of sufficient experience in the field of collective proceedings, as an employee of a mandataire judiciaire and under his direct supervision. The traineeship may be completed for a period not exceeding one third of its duration with a person practising a regulated legal profession…

The provisions of the first paragraph of article R. 811-17 relating to traineeships are applicable to persons entered on the traineeship register.

The provisions of article R. 811-18 relating to the training certificate and the refusal to issue this certificate are applicable to persons entered in the training register.

The panel responsible for conducting the aptitude test for judicial representatives is that provided for in Article R. 811-19. However, the two judicial administrators are replaced by two judicial representatives appointed after consultation with the Conseil national des administrateurs judiciaires et des mandataires judiciaires. The articles R. 811-20 and R. 811-21 are applicable.

The provisions of articles R. 811-22 to R. 811-24 relating to the aptitude examination are applicable to candidates for the profession of judicial representative. The examination is organised under the conditions defined in article R. 811-22.

I. – Pursuant to the provisions of the eighth paragraph of Article L. 812-3, are exempt from professional training: – court-appointed administrators, lawyers, notaries, auctioneers, bailiffs, commercial court clerks, former solicitors, chartered accountants, auditors who have practised their profession for at least ten years; – persons who have worked for at least ten years as an assistant to a judicial representative; – persons who hold one of the qualifications or…

I.-Judicial administrators who have been registered for at least five years on the list referred to in Article L. 812-2 and who have, where applicable, completed the training period under the conditions provided for in II of Article R. 812-13 are exempt from all the qualifying examination tests. In application of the last paragraph of Article L. 812-3, persons who have successfully completed a course of study of at least three years’ duration or of an equivalent duration on a part-time basis at a university or higher education establishment or at another establishment with the same level of training and, where applicable, the professional training required in addition to this course of study and who can show: 1°…

Unless the knowledge they have acquired in the course of their professional experience is such as to make such verification unnecessary, the persons mentioned in Article R. 812-15 take an examination to test their knowledge, organised by the Conseil national des administrateurs judiciaires et des mandataires judiciaires, before the panel responsible for the examination for access to the traineeship, the syllabus and procedures for which are laid down by order…
